Judge denies bankruptcy for Massachusetts man who works in cannabis industry

Judge denies bankruptcy claim due to cannabis job

A United States Bankruptcy Judge for the District of Massachusetts issued a ruling on January 17th, 2023 denying a man’s petition for Chapter 13 bankruptcy because he was an employee at a cannabis dispensary who willfully and repeatedly violated federal law. Chief Judge Elizabeth Katz explained in her decision the individual planned on using his wages from the marijuana dispensary to fund the Chapter 13 plan of reorganization. The man, who does not have an ownership stake in the dispensary, is still engaged in the conspiracy to violate federal law that prohibits the distribution, sale, or possession of marijuana according to Judge Katz. The Court must abide by what federal law says and in this instance Judge Katz ordered that the mans case be dismissed.
